Eileen house benefit party and workshops sat 23rd march

Last week, a vulnerable bungalow was at risk of occupation in Kent. Thankfully, the squatting law was in effect. The absent owner of the bungalow could rest safe in the knowledge that the police were preventing a homeless man from seeking shelter in the forgotten property in -2 degree conditions.
The otherwise healthy 35-year-old man Daniel Gauntlett died of hypothermia. But at least private property was protected from a squatter.

Court case won by former Friern Barnet Library activists



The Friern Barnet Library Activists have moved on to a new project in Enfield Borough in an attempt to fight austerity, homelessness and unjust squatting laws.

The community activists who were previously caretakers of the Friern Barnet Library, are now residing at the Arnos Family Resource Centre (ARC). They won their court case against Enfield Council on the 11th of March 2013 at the Barnet County Court.

Many of the activists arrived at court to defend the case being brought forward by Enfield Council for possession of the property. They were accompanied by several members of the Friern Barnet community who also sent over 20 letters of support.

The judge threw out the case because Enfield’s barrister missed the court hearing. The judge also commented there were procedural errors with Enfield Council’s paperwork.

This means that the activists are to remain in the space, giving them the opportunity to provide community workshops, and more time to negotiate a deal with the council preventing more taxpayer’s money being squandered. Pete phoenix, a veteran community organiser and part of the FB Library campaign/Occupy movement, said:

“We have constantly offered to negotiate with Enfield Council as we did with Barnet Council. We hope that money can be saved on costly court cases and that more arrangements for temporary use can be made, between property owners of some of the 1.4 million empty buildings in the UK and groups who need homes and community space. The new law on squatting has already led to people freezing to death this winter. We want solutions to the housing crisis. Homes for all, not jails!”

The community activists are using the former family resource centre to provide activities such as skill-sharing and workshops with a focus on health, art and education. It has been opened to the community to provide a place for different community groups to come and use.

The activists are hoping to form a mutual agreement with the council to keep the building accessible for the use of the community.

Campaign to repeal new squatting law launched in Parliament

Entitled ‘The Case Against Section 144’, SQUASH (Squatters Action for Secure Homes) are launching a new report and campaign in Parliament today.

The report’s findings suggest the major concerns regarding criminalisation that arose during the government’s consultation process have been proven right, with homeless and vulnerable people disproportionately affected. No arrests so far have been for squatters displacing anyone from their home, which does suggest that the Criminal Law Act 1977 was sufficient for dealing with squatters – as predicted by many legal experts.

The report concludes with a call for repeal of Section 144. It provides a detailed six-month analysis of the effects that the new legislation has had since its introduction in September 2012, and sets this against the wider backdrop of the UK recession, high homelessness rates and current housing crisis.

The report will be launched today in the House of Commons at a meeting of concerned MPs, Lords, lawyers, homelessness groups and academics. An online government e-petition petition calling for repeal has reached over 2000 signatures in only a few weeks.

Last week, a homeless person in Kent died outside of an empty bungalow, media reports suggest he was prevented from going inside the building by Police because of the new offence of Section 144 which makes it a criminal offence to squat inside a residential property.

SQUASH campaigner Joseph Blake said:

“The new law is appalling. Homeless people are being put in jail for using empty buildings to keep a roof over their head. Section 144 needs to go and any further criminalisation quickly dismissed”.

Professor Danny Dorling, endorsing the report said:

“Squatting is what people do when they get desperate, it is not criminal behavior. Squatting rises when inequalities increase and housing is not treated as a necessity. This is a great report – every MP needs to read it.”

John Mcdonnell (Labour MP) said:

“”This meticulously researched report confirms what we feared about the effect of the new laws criminalising squatting. People are being made unnecessarily homeless and very vulnerable people are suffering as a consequence. This legislation was based upon prejudice and has only made matters worse. This new evidence demonstrates so clearly the need to repeal this misguided law.”

Baroness Miller of Chilthorne Domer (Lib-Dem Peer) said:

“A few months after the Government brought in the disgraceful law criminalising the homeless occupying an empty house we can see that some of the most needy are indeed suffering in the way that we feared. This is a very useful report that should make people think hard.”

Since the introduction of the new anti-squatting legislation on the 1st September conditions have obviously got more difficult for those trying to house themselves or make other use of empty properties.
The law (S144 LASPO 2012) makes it a criminal offence to be trespassing in a residential property with the intention of living there.
Some people have been arrested and a few imprisoned for the crime of trying to house themselves. There is no evidence that the properties they were in have been put to use since, nor that any more affordable and accessible housing has been produced. In fact housing costs, particularly in London continue to increase and benefit caps affect increasing numbers of people.
Some people have moved out of their homes, many who had been living in them and looking after them for years after the owners had abandoned them. Other people remain in their homes despite the new law, determined to resist for as long as possible.
People who know about the law change are generally now squatting in non-residential buildings, pubs, offices, warehouses …… These require people to be more organized, and to able to work in groups, so excluding some of the more vulnerable people who have in the past been able to fall back on squatting. They are also more likely to put people into confrontations with owners and their agents who do not know or care about the law. However many on-residential properties can be made into perfectly good homes, and social spaces, and some owners can be made to understand the benefits of properties being occupied and looked after.
The police have acted in a fairly arbitrary manner, in most cases waiting for someone claiming to be an owner to come forward, and then most often accepting their statements even if their version is challenged. On other occasions police appear to have made up their own mind that the occupiers were trespassing (against whom not always being clear). Some police have somehow not understood that a funeral parlour is not residential, have threatened people with arrest who were not living or intending to live to live in the property and many police are confused about the part of the law which says that people who have had a licence are not committing an offence. Advisory Service for Squatters and Squatters Legal Network intend to follow up on these abuses and will be encouraging those affected to sue.
Some parts of the government continue to put on pressure to make things worse, by criminalizing squatting in non-residential properties as well. This is despite the fact that their campaign was previously based on the false idea that people’s homes were being squatted and that this needed to be stopped. [in fact legislation in existence since 1977 made this illegal already]
ASS, along with Squatters Legal Network, SQUASH (Squatters Action for Secure Homes) and others, will continue to struggle for people to be able to house themselves, and to put empty property to use.
